It’s a deal!

Once all conditions have been removed from the offer, the contract is considered firm and both parties are expected to honour the agreement they’ve made without condition. At this point we will assume that you will be conveying the property to the buyer on the date stated within the offer document.

The seller is responsible for the “preparation of the title transfer” so it’s now time to send copies of the agreement to your lawyer. We’ll look after doing that as soon as you advise us of whom you’d like to use. If you don’t know any lawyers who practice in real estate we’d be happy to recommend a competent and experienced person who can assist you.

The selected lawyer will look after searching the title of the property so he or she can ensure that you’re delivering a clear title to the buyer as you’ve promised to do in the agreement. An estimated “pay-out statement” will be requested on your behalf for any items that appear on the property title.

At some point prior to possession, the lawyer’s office will contact you to arrange an appointment for your signature. Once signed, they will forward the transfer document to the buyer’s lawyer so that the buyer can sign it as well.

Your lawyer will ensure that the “balance of any cash portion” of the purchase price has been received in their office, and that all necessary documents have been completed. Once that person is satisfied that your interests are protected they will provide our team with authorization to release keys to the buyer, or the buyer’s agent on possession day.

In the mean time, you’ll just need to arrange for a final reading on your utilities, put in a change of address at the post office, and arrange for the discontinuation of insurance coverage. Please discuss the timing of the insurance item with your lawyer.
